Agreement to Participate, Waiver of Liability, and Release The Church is the sponsor of the Activity and is willing to permit the Participants to participate in the Activity, upon the terms and conditions of this Agreement. In consideration for the ability to participate in the Activity and enter the Premises, by signing below, each Participant individually and on behalf of any minor for which Participant is a parent or legal guardian, hereby understands, acknowledges, and agrees as follows: Assumption of Risk. Participant understands and acknowledges the following: the Activity may be dangerous and may involve the risk that Participant will sustain serious injury, temporary or permanent disability, death, and/or property damage; the Activity may not be supervised; the Church does not provide medical services; and any injury Participant may sustain while participating in the Activity may be compounded by negligent or delayed medical service or negligent or delayed assistance by the Church. PARTICIPANT VOLUNTARILY AND FREELY ASSUMES ALL RISKS AND DANGERS THAT MAY OCCUR PURSUANT TO PARTICIPANT’S USE OF THE PREMISES AND PARTICIPATION IN THE ACTIVITY, INCLUDING THE RISK OF INJURY, DEATH, OR PROPERTY DAMAGE, EVEN IF CAUSED BY NEGLIGENCE OF THE CHURCH. Release; Covenant Not to Sue; Indemnification. Participant, on behalf of Participant and its heirs and personal representatives (collectively, the “Releasors”), hereby fully and forever discharges and releases the Church and its affiliates, and their respective directors, trustees, officers, partners, agents, operators, managers, employees, contractors, volunteers, agents, and representatives (the “Releasees”) from any and all claims Participant may have or hereinafter have for any injury, temporary or permanent disability, death, damages, liabilities, expenses, and/or causes of action, now known or hereinafter known in any jurisdiction in the world, attributable or relating in any manner to Participant’s entry upon and use of the Premises and participation in the Activity, whether caused by the negligence any of the Releasees or by any other reason. Participant understands this Agreement is intended to be, and is, a complete release, as much as allowed by law, of any responsibility of the Releasees for all personal injuries, temporary or permanent disability, death, and/or property damage sustained by Participant while on or using the Premises or participating in the Activity. The Releasors shall not sue the Releasees or initiate or assist in the prosecution of any claim for damages or cause of action against the Releasees which the Releasors may have as a result of any personal injury, death or property damage the Releasors may sustain while on or using the Premises or while participating in the Activity. The Releasors shall defend, indemnify, and hold harmless the Releasees from and against any third-party losses, damages, actions, suits, claims, judgments, settlements, awards, interest, penalties, expenses (including reasonable attorney fees) and costs of any kind for any personal injury, loss of life or damage to property sustained by reason of or arising out of the Releasors’ use of the Premises or participation in the Activity.
